Bittime - The crypto world is filled with uncertainty regarding the SEC's approval of the ETH Futures ETF. However, several ETF issuers remain optimistic about the green light from the United States financial regulator.
A Revealed Report
A report from Fox journalist Eleanor Terrett said that a number of issuers applying for leveraged ETH Futures ETFs had “positive dialogue” with SEC staff.
This optimistic stance comes amid accusations that the SEC is considering Ethereum as a security.

Terrett added that one of the ETH Futures ETF issuers expressed "optimism" that the SEC would approve their product based on communications so far. If there is no resistance, Volatility Shares' 2x Ether Strategy ETF ($ETHU) is scheduled to launch on June 4.
Volatility Shares previously launched a leveraged Bitcoin futures ETF (BITX) in June last year, six months before SEC approval for a Bitcoin Spot ETF. According to Forbes, BITX is now the largest holder of Bitcoin futures contracts on the CME.

SEC's Confusing Stance on Ethereum
Apart from the ETH Futures ETF, SEC Chairman Gary Gensler reportedly held the view that Ethereum (ETH) was a security last year.
A Fox Business article dated April 29, 2024 said Gensler considered Ethereum an unregistered security for at least one year.
This view differs from previous SEC statements regarding Ethereum's status as a commodity.

If the new investigation establishes Ethereum as a security, this would contradict the financial regulator's previous assertions.
After receiving the Wells Notice from the SEC, Consensys filed suit in a Texas court. One of their arguments is that the Commission has returned to its original position regarding the classification of Ether.
Consensys accused the SEC of attempting to monopolize the Bitcoin market. An SEC report in 2018 stated that the second largest cryptocurrency was not a security. This gave rise to accusations of bias following the SEC's involvement in the Ripple controversy.
